ZULU SURF ADVENTURES INDEMNITY / WAIVER I/We the undersigned Full name(s): ... .. Do on my/our own behalf and on behalf of my /our dependents, minor children, heirs, executors, trustees, successors and assigns hereby acknowledge and agree:- 1. That Zulu Surf Adventures is proprietors, its, Employees, Successors-in-Title or Assigns (all of whom are hereinafter referred to as Zulu Surf Adventures), shall not be liable for any expense, loss, damage or personal injury sustained by me/us or my/our minor children as a result of any past or future act or omission, whether intentional or negligent, breach of contract, or any other cause of whatever nature. 2. To waive and abandon all rights of action, which may arise against Zulu Surf Adventures as a result of person injury, expense, loss or damage sustained by me/us and/or my/our minor children before, during and after the tour programme. 3. That, in no way derogating from the above:- a. The use of all and any facilities or property provided, and the partaking or all and any activities reserved, arrange, advised or suggested by Zulu Surf Adventures is done so at my/our or my/our childrens or my/our groups own risk and b. I/we have been warned or made aware of the dangers of the sea, wild animals, sharks and other sea creatures, malaria, bilharzia, exposure to sun, travel and other dangers which exist in the area of the tour programme reserved or arranged by Zulu Surf Adventures. 4. That I/we shall indemnify Zulu Surf Adventures against all and any claims or causes of action by any natural or legal person or third party arising from any or my/our or my/our childrens past or future acts or omissions. 5. That no variation of this document and it shall be binding unless reduced to writing, agreed to and signed by me/us and Zulu Surf Adventures. 6. That if any term of this agreement is invalid or unenforceable or is held to invalid or unenforceable for any reason whatsoever, this shall not affect that validity or enforceability of the remaining provisions of this agreement. 7. That the laws of the Republic of South Africa given the application of this agreement. 8. That my general health and that of my minor children is good and there is nothing which renders me unfit to undertake the tour. 9. That I understand and appreciate full the fact that there may well be hazards and dangers involved to which I would be subjected in participating in a surfing tour organised by Zulu Surf Adventures in South Africa and Mozambique and I voluntarily assume the risk thereof, in respect of myself and my minor children. 10. That I am fully aware of the damages associated with the use of quad-bikes, and micro-lites, and of the damages inherent in flow-riding, and shark diving and that I voluntarily assume the risk in participating in such activities in respect of myself and my minor children.
